Website Terms of Use

These Website Terms of Use (the “Terms”) form a binding agreement between EnStream LP, by its general partner EnStream Inc. (“EnStream”, “we”, “us”, “our”), and each person or entity (“you”) that accesses or uses our website and online pages that link to these Terms (collectively, the “Website”). By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.

If you access the Website on behalf of an entity, you represent that you are authorized to bind that entity to these Terms (and “you” includes that entity).

1. Ownership & Permitted Use

The Website and all content on it—including text, graphics, logos, icons, images, software, audio, video, and other materials (collectively, the “Content”)—are owned by EnStream or our licensors and are protected by intellectual‑property laws. Subject to these Terms, EnStream grants you a personal, non‑exclusive, non‑transferable, revocable, limited licence to access and use the Website for lawful, personal or internal business purposes. Except for this licence, no rights are granted by implication or otherwise.

You must not copy, mirror, frame, scrape, index, reproduce, distribute, publicly display, or create derivative works from the Website or the Content except as expressly permitted by these Terms.

2. Website information; no reliance

The Website and Content are provided for general informational purposes only and do not constitute technical, legal, compliance, or other professional advice. You are solely responsible for how you use the Website and for verifying any information before relying on it.

Nothing on the Website changes any written agreement you may have with EnStream for products or services.

3. Privacy; cookies and similar technologies

Your use of the Website is subject to our Privacy Policy, which explains how we collect, use, disclose and protect personal information. The Privacy Policy is incorporated by reference into these Terms.

Cookies & consent. We use cookies, pixels, SDKs and similar technologies to operate and improve the Website. Non‑essential cookies (for example, analytics or advertising) are off by default and will only be enabled after you provide explicit, opt‑in consent via our cookie banner or preference centre. You can change or withdraw consent at any time. For details, see our Privacy Policy and Cookie Notice.

CASL notice. Certain tracking technologies may be considered “computer programs” under Canada’s anti‑spam law. We do not install such technologies on your device in the course of a commercial activity without your express consent.

4. Third‑party websites and services

The Website may contain links to third‑party websites or services. We do not control and are not responsible for third‑party content, products, services, terms or privacy practices. Your use of third‑party sites and services is at your own risk.

5. User Content and feedback

If the Website allows you to submit, post, or upload content (“User Content”), you represent and warrant that you own or have obtained all necessary rights and permissions to do so and that your User Content:

  • does not infringe intellectual‑property, privacy, or publicity rights;
  • is not illegal, defamatory, harassing, hateful, or otherwise objectionable;
  • does not contain personal information about others without their consent; and
  • does not contain malware or harmful code.

You grant EnStream a worldwide, royalty‑free, non‑exclusive, sublicensable licence to host, store, reproduce, display, perform, and distribute your User Content solely to operate, provide, and improve the Website. To the extent permitted by law, you waive moral rights in your User Content. We may remove or disable access to User Content at our discretion.

If you provide feedback or suggestions, we may use them without restriction and without any obligation to you.

6. Security; communications

We take reasonable steps to protect the Website but cannot guarantee it will be free of errors, vulnerabilities, or malicious code. Do not submit sensitive information through Website forms that are not designated as secure. Communications over the internet may not be confidential.

We may monitor Website use to operate, secure and improve the Website, investigate security incidents, and enforce these Terms. We may disclose information as described in our Privacy Policy or where required by law.

7. Acceptable Use

You will not: (a) reverse engineer, decompile, or disassemble any part of the Website; (b) access the Website using automated means other than search‑engine crawlers compliant with robots.txt; (c) interfere with or disrupt the Website; (d) use the Website for unlawful purposes; or (e) remove or obscure proprietary notices.

8. Disclaimers

THE WEBSITE AND THE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES, REPRESENTATIONS OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE. YOUR USE OF THE WEBSITE IS AT YOUR OWN RISK.

Some jurisdictions do not allow the exclusion of certain warranties. In such cases, only the exclusions lawfully permitted will apply.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ENSTREAM AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE WEBSITE OR THESE TERMS.

Where liability cannot be excluded, it will be limited to CAD $100 in the aggregate or the minimum amount permitted by law, whichever is greater.

10. Changes; availability

We may change the Website or these Terms at any time. If changes are material, we will take reasonable steps to notify you (e.g., by posting a notice on the Website). Your continued use of the Website after changes take effect means you accept the changes. We may suspend or discontinue the Website at any time.

11. Termination

We may suspend or terminate your access to the Website immediately with or without notice if we believe you violated these Terms, to comply with law, or for operational/security reasons. Upon termination, the licences granted to you end and you must stop using the Website.

12. Accessibility (Ontario)

We are committed to providing accessible services and information. Upon request, we will provide accessible formats and communication supports for Website content, in accordance with applicable accessibility laws.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The parties irrevocably submit to the exclusive jurisdiction of the courts of Ontario, sitting in Toronto.

Quebec users: If you are located in Quebec, non‑essential cookies and similar technologies are disabled by default and will only be enabled after you provide express consent.

15. General

Severability: If any part of these Terms is invalid, the remainder remains in effect.

No waiver: A failure to enforce any provision is not a waiver.

Entire agreement: These Terms and documents incorporated by reference form the entire agreement regarding your use of the Website.
